New Zealand Transport Agency (Auckland Electric Vehicles Trial) Bylaw 2017

Pursuant to section 61(3) of the Government Roading Powers Act 1989 and section 22AB(1)(r) of the Land Transport Act 1998, the NZ Transport Agency makes the following bylaw.

Bylaw

1. Title—This bylaw is the New Zealand Transport Agency (Auckland Electric Vehicles Trial) Bylaw 2017.

2. Commencement—(1) Clause 5 comes into force on the day after the notification of this bylaw in the New Zealand Gazette.

(2) The rest of this bylaw comes into force on 6 March 2017.

3. Revocation—This bylaw will be revoked on 20 March 2017.

4. Interpretation—(1) In this bylaw:

electric vehicle means a motor vehicle with motive power wholly or partially derived from an external source of electricity.

registered owner means the person registered in the register of motor vehicles in respect of a vehicle.

(2) A term that is used in this bylaw and defined in the Land Transport Act 1998 but not defined in this bylaw has the meaning given in that Act.

5. NZ Transport Agency to supply EV stickers to registered owners of electric vehicles—(1) The NZ Transport Agency must supply an EV sticker in the form set out in Schedule 1 to the registered owner of any electric vehicle that is registered in the Auckland region.

(2) The registered owner of an electric vehicle that is registered outside of the Auckland region may request an EV sticker and, if so requested, the NZ Transport Agency must supply the EV sticker in the form set out in Schedule 1 to the registered owner.

6. Electric vehicle may use specified special vehicle lanes—(1) An electric vehicle may travel in a special vehicle lane specified in Schedule 2.

(2) An electric vehicle must not travel in a special vehicle lane specified in Schedule 2 unless an EV sticker supplied by the NZ Transport Agency under clause 5 is displayed:

  1. in the rear window of the electric vehicle; or
  2. in the rear right-hand side window of the electric vehicle.

7. Authority to make bylaw—This bylaw was made by the Chief Advisor (Technical Services) Highways and Network Operations, under the delegated authority of the NZ Transport Agency.

T2 and truck lane adjacent to the on-ramp northbound from Mt Wellington Highway to State Highway 1 Southern Motorway (Mt Wellington).

T2 and truck lane adjacent to the on-ramp eastbound from Lincoln Road, to State Highway 16 North Western Motorway (Henderson).
