Electricity Industry (Exemption No. 264 (Electra Services Limited)) Exemption Notice 2017

Under section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Industry (Exemption No. 264 (Electra Services Limited)) Exemption Notice 2017.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption—Electra Services Limited (“Electra”) is exempted from complying with the obligation in clause 15.38(1) of the Electricity Industry Participation Code 2010 (“Code”) to be certified to perform specified functions relating to reconciliation.

3. Term—This exemption expires on the earlier of:

  1. the close of 13 July 2019;
  2. the date on which Electra gains responsibility for an installation control point (ICP) as a trader; and
  3. the date on which the requirement to deliver submission information to the reconciliation manager by 1600 hours on the 13th business day of the reconciliation period has not been satisfied by Simply Energy Limited (“Simply”), on behalf of Electra under clause 15.4(2) of the Code.

4. Reasons for granting the exemption—The reasons for granting this exemption are:

  1. Electra is no longer responsible for any ICPs;
  2. Electra has completed final meter reads for ICPs it was previously responsible for;
  3. Electra has contracted Simply, a certified reconciliation participant, to perform its reconciliation obligations;
  4. the exemption will have no impact on the accuracy of submission information; and
  5. the exemption meets the requirements in section 11(2) of the Act.
