An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 16 January 2017, the register will be updated to record the easement as redundant.

Easement: Right to support a retaining wall over part Lot 28 DP 466435 marked “AB”, “AC” and “AD” on DP 466435 comprised in Computer Freehold Register 622892, part Lot 29 DP 466435 marked “AA” on DP 466435 comprised in Computer Freehold Register 622893, part Lot 40 DP 466435 marked “AS” and “AT” on DP 466435 comprised in Computer Freehold Register 622895, and part Lot 41 DP 466435 marked “AP”, “AQ” and “AR” on DP 466435 comprised in Computer Freehold Register 622896 in favour of Lot 1 DP 494222 comprised in Computer Freehold Register 743809 and Lot 202 DP 494222 comprised in Computer Freehold Register 722636 and created by Easement Instrument 9675165.3 registered on 13 May 2014.

Circumstances: The dominant tenements have become physically separated from the servient tenements as a result of the subdivision shown on DP 494222.
