The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a drainage right easement.

The applicant claims the drainage right easement is redundant by reason of the circumstances set out below.

I intend to remove the drainage right easement described below on 15 December 2016 if no objections have been received before that date.

Applicant: Nelson City Council, PO Box 645, Nelson 7010.

Easement: A drainage right easement to drain through the covered drain over part Lot 2 DP 244 marked “D–C” and “C–A” on DP 224 appurtenant to Lot 3 DP 475938, Lot 4 DP 475938, Lot 5 DP 475938 and Lot 6 DP 475938 created by Transfer 9350 – 12 September 1907 at 11.00am.

Circumstances: The covered drain was replaced with a 300mm diameter pipe in 1930 in a different location therefore water is no longer drained over the areas marked “D–C” and “C–A” on DP 224.
