An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

Easement: Right to drain water marked “K” on DP 344586 over Lot 3 DP 344586 comprised in Certificate of Title 182877, marked “J” and “K” on DP 397348 over Lot 1 DP 397348 comprised in Certificate of Title 388566 and marked “E”, “F”, “L” and “M” on DP 397348 over Lot 2 DP 397348 comprised in Certificate of Title 388567 (servient tenements) appurtenant to Lot 2 DP 175658 comprised in Certificate of Title NA108A/525, Lot 3 DP 175658 comprised in Certificate of Title NA108A/526, Lot 1 DP 185338 comprised in Certificate of Title NA115C/863, Lot 2 DP 185338 comprised in Certificate of Title NA115C/864 and Lot 3 DP 185338 comprised in Certificate of Title NA115C/865 (dominant tenements) created by Transfer B358228.2 registered on 4 December 1984.

Circumstances: The dominant tenements have become physically separated from the servient tenements as a result of subdivision shown on DP 119462.
