Fisheries (SCA7 Partial Closure) Notice 2016 (Notice No. MPI 649)

Pursuant to section 11(4) of the Fisheries Act 1996 (“Act”) and having had regard to the matters specified in sections 11 and 12 of the Act, I give the following notice.

Notice

1. Title—This notice may be cited as the Fisheries (SCA7 Partial Closure) Notice 2016.

2. Commencement and expiry—This notice shall come into effect the day after the date of its notification in the New Zealand Gazette and expire on 14 February 2017.

3. Closed part of quota management area SCA7 defined—The closed part of quota management area SCA7 is:

  1. all the waters defined as the “Marlborough Sounds area” in Regulation 11 of the Fisheries (Challenger Area Commercial Fishing) Regulations 1986; plus
  2. scallop statistical reporting area 7HH, being all those waters enclosed by a line:
    1. commencing at a point on Pepin Island (at 41°08.400′S and 173°24.800′E); then
    2. proceeding in a generally north-westerly direction to a point at 41°02.800′S and 173°16.100′E; then
    3. proceeding in a generally easterly direction to Okuri Point (at 40°58.600′S and 173°45.700′E); then
    4. proceeding by the mean high-water mark in a generally south-westerly direction to the point of commencement.

4. Prohibition on taking scallops—A person must not:

  1. take scallops from the closed part of quota management area SCA7; or
  2. possess any scallops taken from within the closed part of quota management area SCA7.
