Amendment of Notice of Direction to Appoint a Limited Statutory Manager for the Papakura High School (101) Board of Trustees

Under section 78M(6) of the Education Act 1989, and under delegated authority, the notice (as published in the New Zealand Gazette, 30 January 2014, No. 11, page 272) directing the Secretary for Education to appoint a limited statutory manager for the Papakura High School (101) Board of Trustees is amended by replacing

“The following functions, powers and duties are vested in the limited statutory manager:

      • All functions, powers and duties of the board as an employer (whether statutory or otherwise).

A limited statutory manager must also advise the board on board systems and processes.”

with

“The following functions, powers and duties are vested in the limited statutory manager:

      • All functions, powers and duties of the board as an employer (whether statutory or otherwise);
      • all functions, powers and duties of the board in curriculum management, including teaching and assessment practice (whether statutory or otherwise); and
      • all functions, powers and duties of the board in the development and implementation of an action plan to address the recommendations and compliance issues identified in the September 2015 Education Review Office Report (whether statutory or otherwise).

A limited statutory manager must also advise the board on board systems and processes.”

The board will retain its primary duty of care as a person conducting a business or undertaking, under the Health and Safety at Work Act 2015, above and beyond all functions, powers and duties of this limited statutory manager.

This notice takes effect on the date of publication.
