Student Allowance Transfer Grant Amendment 2014

Pursuant to section 124(1)(d) of the Social Security Act 1964, the Minister for Social Development makes the following instrument.

I n s t r u m e n t

1 Title—This instrument is the Student Allowance Transfer Grant Amendment 2014.

2 Commencement—This instrument comes into force on the day after it is made.

3 Principal programme—This instrument amends the Student Allowance Transfer Grant Programme (as established and approved on 23 July 2002 February 1999)1 (the principal programme).

4 Clause 4 amended (Interpretation)—In clause 4(1), insert in their appropriate alphabetical order:

full-time course has the same meaning as in the Regulations

full-time student

  1. has the same meaning as in section 3(1) of the Act; and
  2. includes a person who, during the period between the end of the portion of a full-time course during a calendar year and the start of the next portion during that same year, was enrolled in that portion of that course and who intends to continue study in the next portion of that course; and
  3. also includes a person who, during the period between the end of a portion of a full-time course during a calendar year (portion A) and the start of a portion of a full-time course during that same year (portion B), was enrolled in portion A and who intends to enrol in portion B”.

5 Clause 6 amended (Transfer grants)—(1) In clause 6.1(e), replace “5 working days” with “28 days”.

(2) In clause 6, after subclause (1), insert:

“(1A) Subclause (2) also applies to an applicant for a working-age benefit to whom subclause (1)(b) and (c) apply and who—

  1. is a full-time student; and
  2. applies for the working-age benefit to support himself or herself during the period between—
    i. the end of an academic year and the start of the next; or
    ii. the end of a portion of a full-time course and the start of a portion of that course or another full-time course during the same calendar year; and
  3. is applying for the working-age benefit because he or she will cease to receive the student allowance by reason of the end of the academic year or portion of the full-time course, as the case may be; and
  4. applies for a transfer grant before or within 28 days after the specified period ends.”

Explanatory Note

This note is not part of the instrument, but is intended to indicate its general effect.

This instrument, which comes into effect on the day after it is made, amends the Student Allowance Transfer Grant Programme under the Social Security Act 1964 to make it easier for sole parents to receive the grant when they apply for a working-age benefit to support themselves during academic breaks. The amendment extends the period during which applications for the grant can be considered from five working days after their student allowances stops to 28 days.
