Notice of Urgent Amendment to the Acceptable Solutions and Verification Method for New Zealand Building Code Clauses C1 to C6 and to Materials Incorporated by Reference into the Acceptable Solutions and Verification Method for New Zealand Building Code Clauses C1 to C6, and Where They are Available for Inspection and Purchase

Urgent amendment to Acceptable Solutions and Verification Method for New Zealand Building Code clauses C1 to C6 Protection from Fire
Pursuant to sections 24(1) and 29(5) of the Building Act 2004 ("Act"), I give notice of an urgent amendment
to the Acceptable Solutions and Verification Method for New Zealand Building Code clauses C1 to C6 Protection from Fire (Acceptable Solutions C/AS1 to C/AS7 and Verification Method C/VM2).
The amendment modifies the Acceptable Solutions for Protection from Fire (C/AS1 to C/AS7) and the Verification Method for Protection from Fire (C/VM2) urgently as some of the requirements in these documents are causing unnecessary costs and delays to the construction and alterations of buildings.
The urgent amendments to the Acceptable Solutions and Verification Method for New Zealand Code clauses C1 to C6 come into force on 19 December 2013 ("effective date").
The previous version of these documents (prior to their amendment), ie C/AS1-AS7 Errata 1 and C/VM2 Errata 2, may be used until the close of 18 June 2014 to demonstrate compliance with Building Code Clauses C1 to C6 Protection from Fire.
The Acceptable Solutions and Verification Method for
New Zealand Code clauses C1 to C6 are available
for download free of charge from the Ministry of Business, Innovation and Employment's (the Ministry) website at
www.dbh.govt.nz
In accordance with section 30(2) of the Act, the chief executive of the Ministry will consult on, and publicly notify whether he has decided to confirm or otherwise,
this urgent amendment within six months of the date of this notice.
New material incorporated by reference under urgency
As part of this urgent amendment, and pursuant to sections 405 and 410(1)(e) of the Building Act 2004 ("Act"), I give notice that AS 4254:2012 will be incorporated by reference into Verification Method C/VM2 effective on 19 December 2013.
The previous version of this Verification Method (prior to its amendment), ie C/VM2 Errata 2, may be used until the close of 18 June 2014 to demonstrate compliance with Building Code Clauses C1 to C6 Protection from Fire.
Consultation on this incorporation by reference will be carried out as part of the consultation under section 30(2) of the Act that is referred to above.
Amendment to material incorporated by reference
under urgency
As part of this urgent amendment, and pursuant to sections 406(c)(ii) and 410(1)(e) of the Building Act 2004 ("Act"),
I give notice that reference to NZS 4541:2007 A1 will
be replaced by NZS 4541:2013 in Acceptable Solutions C/AS1-AS7 and Verification Method C/VM2 effective on 19 December 2013.
The previous version of these documents (prior to their amendment), ie C/AS1-AS7 Errata 1 and C/VM2 Errata 2, may be used until the close of 18 June 2014 to demonstrate compliance with Building Code Clauses C1 to C6 Protection from Fire.
Consultation on this incorporation by reference will be carried out as part of the consultation under section 30(2) of the Act that is referred to above.
New material incorporated by reference
Pursuant to section 405 and 410(1)(e) of the Building Act 2004 ("Act"), I give notice that the AS/NZS 5601.1:2010, A1 is incorporated by reference into Acceptable Solutions
C/AS1-AS6 effective on 19 December 2013.
The previous version of these Acceptable Solutions (prior to their amendment), ie C/AS1-AS6 Errata 1, may be used until the close of 18 June 2014 to demonstrate compliance with Building Code Clauses C1 to C6 Protection from Fire.
Amendment to material incorporated by reference
Pursuant to sections 406(c)(ii) and 410(1)(e) of the Act,
I give notice that the material incorporated by reference, as set out in Column 1 below, are replaced by the material in Column 2 below, in the listed Acceptable Solutions and Verification Method, effective as of 19 December 2013, as follows:

Material proposed to cease having legal effect
Pursuant to section 406(c)(ii) and 410(1)(e) of the Building Act 2004 ("Act"), I give notice that NZS 5261: 2003,
A1 and A2, previously incorporated by reference into Acceptable Solutions C/AS1-AS6, is revoked and will cease to have legal effect as of 19 December 2013.
The previous version of these Acceptable Solutions (prior to their amendment), ie C/AS1-AS6 Errata 1, may be used until the close of 18 June 2014 to demonstrate compliance with Building Code Clauses C1 to C6 Protection from Fire.
