Instrument Amending Ministerial Directions and Welfare Programmes (No. 2) 2013

Pursuant to sections 5 and 124(1)(d) of the Social Security Act 1964, the Minister for Social Development makes the following instrument.
I n s t r u m e n t
1. Title-This instrument is the Instrument amending Ministerial Directions and Welfare Programmes (No. 2) 2013.
2. Commencement-This instrument comes into force
on 15 July 2013.
3. Principal directions and welfare programmes amended-This instrument amends the directions and welfare programmes specified in Schedules 1 and 2
("the principal directions and welfare programmes").
4. Social Security (Benefit Categories and Work Focus) Amendment Act 2013: consequential amendments-Amend the principal directions and welfare programmes
in the manner set out in Schedule 1.
5. Savings provisions-Amend the principal directions and welfare programmes in the manner set out in Schedule 2.

"(b) a reference to an employment trial under section 40K of the Act includes reference to an employment trial commenced before that date under section 44A of the Act before its repeal on that date by section 20 of the Social Security (Benefit Categories and Work Focus) Amendment Act 2013."
Sole Parent Study Assistance Programme (as established and approved on 16 December 2010)17
New clause 6A
After clause 6, insert:
"6A Savings in respect of certain transferees to jobseeker support
"Despite clause 6(1)(a), the chief executive may, in
his or her discretion, from time to time grant recoverable assistance under clause 6(1) in respect of a course to any applicant-
"(a) who was transferred to jobseeker support on 15 July 2013 under clause 2(11) of Schedule 32 of the Act or who is a sole parent to whom clause 12(2) of Schedule 32 of the Act applies, and continues to receive it; and
"(b) to whom clause 12(4) of Schedule 32 of the Act for the time being applies; and
"(c) who-
"(i) was eligible for and receiving assistance under this programme at the close of
14 July 2013; or
"(ii) would have been eligible for assistance under this programme at the close of
14 July 2013, but had not applied for it."

New clause 5B
After clause 5A, insert:
"5B Savings in respect of certain transferees to jobseeker support
"(1) Despite clause 5.1.1(a)(i), the chief executive may, for the appropriate period specified in subclause (2), grant, or continue to grant, an allowance under clause 5.1.1 in respect of a course to any applicant receiving jobseeker support,-
"(a) who was transferred to jobseeker support from a domestic purposes benefit, an invalid's benefit, or a widow's benefit, or a young parent payment under section 165 of the Act, or the emergency benefit known
as the emergency maintenance allowance-
"(i) on 15 July 2013 by clause 2(11) or 10(6) of Schedule 32 of the Act; or
"(ii) at any time after 15 July 2013 either directly or via 1 or more other benefits under section 20H or 81(3) of the Act; and
"(b) if the course is-
"(i) a full-time course within the meaning of the Student Allowances Regulations 1998, to whom clause 12(4) of Schedule 32 of the Act for the time being applies; or
"(ii) not a full-time course within the meaning of the Student Allowances Regulations 1998, whose study in the course does not, in the chief executive's opinion, prevent the applicant meeting his or her work-test obligations and is
a course in which the applicant was studying immediately before 15 July 2013; and
"(c) who-
"(i) was eligible for and receiving an allowance at the close of 14 July 2013; or
"(ii) would have been eligible for an allowance at the close of 14 July 2013, but had not applied for it.
"(2) The period referred to in subclause (1) is-
"(a) for an applicant to whom subclause (1)(b)(i) applies, the period referred to in clause 12(5) of Schedule 32 of the Act:
"(b) for an applicant to whom subclause (1)(b)(ii) applies, a period ending on the date the course referred to in that subparagraph ends in the year."

Explanatory Note
This note is not part of the instrument, but is intended to indicate its general effect.
This instrument, which comes into force on 15 July 2013, amends a number of Ministerial directions and welfare programmes under the Social Security Act 1964 ("the Act").
Clause 4 and Schedule 1 primarily updates references to benefits and sections under which those benefits are granted with references to the replacement benefits and sections enacted in the Social Security (Benefit Categories and Work Focus) Amendment Act 2013. A number of references to specific benefits are replaced with references to the new definition of the term main benefit under this Act inserted into section 3(1) of the Act.
Clause 5 and Schedule 2 creates savings provisions for certain beneficiaries who on 15 July 2013 transfer to jobseeker support or supported living payment under section 40B of the Act from certain former benefits.
