NZ Transport Agency (Traffic Controls on State Highways in Region 11) Bylaw 2012/R11/1

Pursuant to section 61(3) of the Government Roading Powers Act 1989, and sections 22AB(1)(h), (m) and (zk) of the Land Transport Act 1998, the NZ Transport Agency hereby makes the following bylaw.

1. Title and commencement-This bylaw may be cited as the NZ Transport Agency (Traffic Controls on State Highways in Region 11) Bylaw 2012/R11/1 and will come into force 28 days after the date of publication of this notice in the New Zealand Gazette.
2. Interpretation-In this bylaw, unless the context otherwise requires:
Act and Regulation have the same meanings as in section 29 of the Interpretation Act 1999.
agency, driver, motor vehicle and vehicle have the same meanings as in section 2(1) of the LTA.
enactment includes:
(a) Acts and Regulations;
(b) bylaws.
erection of a prescribed sign includes marking a road or part of a road with any road marking which falls within the definition of prescribed sign in this bylaw.
LTA means the Land Transport Act 1998.
prescribed sign means any sign or road marking which is authorised under:
(a) the LTA; or
(b) any rules made pursuant to the LTA, including the TCD Rule; or
(c) any Gazette notice issued under clauses 3.4 or 4.4 of the TCD Rule.
road has the same meaning as in section 2(1) of the LTA and includes a part or parts of a road.
Road User Rule means the Land Transport (Road User) Rule 2004.
TCD Rule means Land Transport Rule: Traffic Control Devices 2004.
3. No stopping, standing or parking-Subject to the erection of one or more prescribed signs, the roads in Schedule A are roads on which a driver or person in charge of a vehicle must not stop, stand or park at any time for the purposes of clause 6.4 of the Road User Rule.
4. Offences and penalties-Without limiting any provision of any other enactment, a person who breaches clause 3 of this bylaw commits an offence and is liable on summary conviction to a fine not exceeding $500.
5. General exceptions-A person is not in breach of this bylaw if the person proves that any act or omission which would otherwise constitute a breach took place in circumstances provided for in subclause 1.8(1), 1.8(3) or 1.8(4) of the Road User Rule.
6. Authority to make bylaw- This bylaw was made by David Bates, Chief Advisor (Professional Services) Highways and Network Operations, under delegated authority of the NZ Transport Agency.
