Fisheries (South Island Customary Fishing) Notice (No. 3) 2011 (No. F577)

Pursuant to Regulation 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Fisheries Manager Customary at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 3) 2011.
(2) This notice shall come into effect on 11 March 2011.
2. Interpretation-In this notice:
(a) "customary food-gathering" has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.
(b) "Tangata Tiaki/Kaitiaki" means the person or persons appointed under Regulations 9 or 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana.
(c) "area/rohe moana" means:
(i) the area from the north bank of the Pouerua River to the Hokitika River; and
(ii) the area from the Hokitika River to the Kawatiri/Buller River; and
(iii) the area from the Kawatiri/Buller River to Kahurangi Point.
The areas above extend seaward to the limit of the
"South Island fisheries waters" as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, and extend:
(A) in terms of sub-area 2(c)(i), inland to boundaries defined for Te Runanga o Makawhio and
Te Runaka o Kati Waewae under Te Runanga
o Ngai Tahu Act 1996; and
(B) in terms of sub-areas 2(c)(ii) and (iii), inland
to boundaries defined for Te Runaka o Kati Waewae under Te Runanga o Ngai Tahu Act 1996.
3. Request to cancel appointment-Te Runanga o Ngati Waewae, representing the whanau and hapu of Ngai Tahu Whanui holding manawhenua manamoana over the area/rohe moana (as represented by Te Runanga o Ngai Tahu), who nominated Rick Barber as a Tangata Tiaki/Kaitiaki for the area/rohe moana, has requested in writing the cancellation of his appointment as a Tangata Tiaki/Kaitiaki.
4. Cancellation of appointment-On 7 February 2011, the Minister of Fisheries and Aquaculture cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Rick Barber as a Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.
5. Nomination of Tangata Tiaki/Kaitiaki-Te Runanga o Ngati Waewae, representing the whanau and hapu of Ngai Tahu Whanui holding manawhenua manamoana over the area/rohe moana (as represented by Te Runanga o Ngai Tahu), has nominated Francois Tumahai as a replacement Tangata Tiaki/Kaitiaki for the area/rohe moana.
6. Appointment of Tangata Tiaki/Kaitiaki-On 7 February 2011, the Minister of Fisheries confirmed, under Regulation 10(2) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Francois Tumahai
as a Tangata Tiaki/Kaitiaki for managing customary
food-gathering in the area/rohe moana. The fixed-term-year appointment will expire on 13 August 2014.
7. Power to authorise the taking of fisheries resources for customary food-gathering-The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary
food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.
