Notification of Kaihuka Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki (No. F547)

Pursuant to Regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Chief Executive of the Ministry of Fisheries gives the following notice:
Pursuant to Regulation 20, by a notice published in the
New Zealand Gazette, 10 June 2010, No. 64, page 1851,
the Minister of Fisheries and Aquaculture declared a mataitai reserve over the fisheries waters around Kaihuka Island (within the Breaksea Islands group), on the east side of Stewart Island.
The Minister of Fisheries and Aquaculture, in an instrument dated on the 31st day of May 2010, appointed Gail Thompson as Tangata Tiaki/Kaitiaki for the mataitai reserve.
The appointment is for a term of five years.
The mataitai reserve and appointment of Tangata
Tiaki/Kaitiaki take effect from 8 July 2010.
The Kaihuka Mataitai Reserve includes all New Zealand fisheries waters enclosed by a line surrounding Kaihuka Island which at every point is 50 metres offshore from the mean high water mark.
Commercial fishing within the mataitai reserve is prohibited under Regulation 24(2) of the Fisheries (South Island Customary Fishing) Regulations 1999.
The Tangata Tiaki/Kaitiaki may authorise any individual to take fish, aquatic life or seaweed for customary food gathering purposes from within the whole or any part of the mataitai reserve.
No fishing for customary food gathering purposes may take place in the mataitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.
