Fisheries (Declaration of Pikomamaku Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010 (No. F527)

Pursuant to Regulations 20, 21 and 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries and Aquaculture hereby gives
the following notice.

1. Title-This notice may be cited as the Fisheries (Declaration of Pikomamaku Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki) Notice 2010.
2. Commencement-This notice shall come into effect
on the 28th day after the date of its notification in the
New Zealand Gazette.
3. Interpretation-In this notice:
(a) "mataitai reserve" means the identified traditional fishing ground described in clause 4 of this notice.
(b) "Tangata Tiaki/Kaitiaki" means any person or persons appointed as Tangata Tiaki/Kaitiaki for the mataitai reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.
4. Declaration of a mataitai reserve-The Minister of Fisheries and Aquaculture hereby declares a mataitai reserve consisting of two separate areas described as follows:
Area 1: All that area of New Zealand fisheries waters enclosed by a line which at every point is along the mean high water mark (MHWM) and within the gulch way (channel) between the north side of Pikomamaku (Womens Island) and the adjacent islet. Area 1 is approximately 0.002 square kilometres (110 metres long and 30 metres wide at the widest point).
Area 2: All that area of New Zealand fisheries waters, approximately 0.04 square kilometres, along the
south-west side of Pikomamaku enclosed by a line:
(a) commencing on the MHWM on the southern tip of Pikomamaku at 46°49.52'S and 168°14.69'E; then
(b) proceeding due south to a point 150 metres offshore from the point of commencement; then
(c) proceeding in a generally north-westerly direction along a line which at every point is 150 metres offshore from the MHWM to a point due west of the northern entrance to Water Well Bay (the 46°49.44'S line of latitude); then
(d) proceeding due east to a point on the MHWM on the northern entrance to Water Well Bay at 46°49.44'S and 168°14.64'E; and then
(e) proceeding in a generally south-easterly direction along the MHWM to the point of commencement.
5. Appointment of Tangata Tiaki/Kaitiaki-Graeme Metzger and Michael Stevens are hereby appointed as Tangata Tiaki/Kaitiaki for the above mataitai reserve. The appointment is for a term of five years.
6. Commercial fishing prohibited area-Commercial fishing within the above mataitai reserve is hereby prohibited under Regulation 24(2) of the Fisheries (South Island Customary Fishing) Regulations 1999.
7. Power to authorise taking of fisheries resources for customary food gathering-The Tangata Tiaki/Kaitiaki may authorise any individual to take fish, aquatic life or seaweed for customary food gathering purposes from within the whole or any part of the mataitai reserve. No fishing for customary food gathering purposes may take place in the mataitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.
