Land Transfer Act Notice

Notice is hereby given that the applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below. I intend to remove the easement on 14 May 2007 if no objections have been received before that date.

Easement: Right of way over Lot 4 DP 369635 (comprised in Computer Freehold Register 282766); being part marked “U”, “U1” and “W” on DP 343088 created by easement instrument 6520959.3 registered 4 August 2005 at 9.00am.
Circumstances: Confirmation of the physical formation of the right of way “AA” and “AB” on DP 343088 having now
been completed and easement “U”, “U1” and “W” on DP 343088 no longer serves the dominant tenements. As provided
in easement instrument 6520959.3, easement “U”, “U1” and “W” DP 343088 will determine and/or extinguish on a
date 40 months from the date of the instrument or earlier upon the confirmation of the completion of right of way
“AA” and “AB” DP 343088.
