Notice of Approval of Hazardous Substances in Special Emergency

Pursuant to section 49H of the Hazardous Substances and New Organisms Act 1996 (“HSNO Act”), the Environmental Risk Management Authority hereby gives notice that on
10 November 2006, it approved an application for the aerial use of Engage Ant Bait and Distance Ant Bait in a special emergency declared under section 49B of the HSNO Act.
The special emergency to which the approval relates is the incursion of the red imported fire ant (Solenopsis invicta)
at Whirinaki as declared by the Minister for Biosecurity on 30 October 2006.
The application was approved pursuant to section 49F of the HSNO Act, with the following controls:
? The substances may only be used if the special emergency is managed in accordance with the treatment management plan and application specified by the applicant;
? Distance Ant Bait shall not be aerially applied within a 50 metre buffer zone around waterways;
? the approval takes effect on the date of this decision and expires on 30 June 2007; and
? on expiry of this approval, the Engage Ant Bait and Distance Ant Bait must not be used by aerial methods, unless, before the expiry of the approval, the applicant has, under any other provision of the Act, been granted an approval.
