Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 – Rule Amendment Proposal No. 80

1. This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 (“Rules”), Rule Amendment Proposal No. 80, is issued by the Electricity Commission (“Commission”), established under the Electricity Act 1992 (“Act”), pursuant to section 172E (2) (c) of the Act and section 13 of the Interpretation Act 1999.
2. Section 172E (2) (c) of the Act provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.
3. Section 13 of the Interpretation Act provides that a statutory power may be exercised to correct an error in
a previous exercise of the power.
Recommendation
4. The Commission made a recommendation on 16 January 2006, that the Minister of Energy’s notice in the
New Zealand Gazette, 22 December 2005, No. 210, page 5383 (“principal notice”) concerning the making of Electricity Governance Amendment Rules (No. 33) 2005, be amended to correct errors in the recommendation to which the principal notice related.
5. The recommended amendment to the New Zealand Gazette notice was to:
(a) refer to a corrected version of Table 1 of Schedule F3A as notified in the principal notice (due to an administrative error, the version of that table contained in the Schedule referred to in the principal notice was incorrect); and
(b) extend the date on which Schedule F3A comes into force to 16 February 2006.
