Transit New Zealand (Transit Lanes) Bylaw 2005/4

Pursuant to section 61 (3) of the Transit New Zealand Act 1989, section 72 (1) (k) of the Transport Act 1962 and section 72 (1) (kb) of the Transport Act 1962, Transit
New Zealand hereby makes the following bylaw.

1. Title and commencement—This bylaw is called the Transit New Zealand (Transit Lanes) Bylaw 2005/4 and comes into force 28 days after the date of its publication
in the New Zealand Gazette.
2. Interpretation—In this bylaw:
“authority” means Transit New Zealand;
“emergency vehicle” has the same meaning as it has in Rule 1.6 of the Land Transport (Road User) Rule 2004;
“passenger service vehicle” has the same meaning as it has in section 2 (1) of the Transport Services Licensing Act 1989;
“public holiday” means a day specified as a public holiday in section 44 (1) of the Holidays Act 2003; and
“vehicle” has the same meaning as it has in section 2 (1) of the Land Transport Act 1998.
3. Transit lanes—(1) The portion of State highway described in the First Schedule is hereby declared to be a transit lane, as defined by the Land Transport (Road User) Rule 2004, between 6.30 a.m. and 9.30 a.m. every Monday to Friday, and 3.30 p.m. to 6.30 p.m. on Sundays and public holidays.
(2) The portion of State highway described in the Second Schedule is hereby declared to be a transit lane, as defined by the Land Transport (Road User) Rule 2004, between 3.30 p.m. and 6.30 p.m. every Monday to Friday, and 11.30 a.m. to 2.30 p.m. on Saturdays.
4. Stopping, standing or parking of passenger service vehicles—Between the hours specified in clauses 3 (1) and 3 (2), a passenger service vehicle may stop at an authorised bus stop or parking bay on the transit lanes described in the Schedules or the purposes of setting down or picking up passengers.
5. Emergency vehicles exempt—Rules 2.3 (1) (f) and
6.6 of the Land Transport (Road User) Rule 2004 do not apply in respect of any emergency vehicle using, stopping, standing or parking in any transit lane described in the Schedules.
6. The authority must mark out lanes and erect signs—The authority must mark out and indicate by traffic signs the transit lanes described in the Schedules and the parking restriction that applies by virtue of Rule 6.6 of the Land Transport (Road User) Rule 2004.
First Schedule
The southbound, kerbside lane of State Highway No. 1 that is at Mana from a point located approximately 68 metres south of the existing Acheron Road intersection with
State Highway No. 1 (approximately 123 metres south of Route Position Marker 1035/14.00) and continuing for a distance of approximately 997 metres to a point located approximately 167 metres north of the northern abutment
of the existing Paremata Bridge (approximately 126 metres south of Route Position Marker 1035/15.00).
Second Schedule
The northbound, kerbside lane of State Highway No. 1 that is at Mana from a point located approximately 294 metres north of the northern abutment of the existing Paremata Bridge (approximately at Route Position Marker 1035/15.00) and continuing for a distance of approximately 812 metres to a point located approximately 123 metres south of the existing Acheron Road intersection with State Highway No. 1 (approximately 174 metres south of Route Position Marker 1035/14.00).
This bylaw was made by resolution passed at a meeting
of Transit New Zealand held in Wellington on 7 September 2005.
