Transit New Zealand (Maximum Speeds of Vehicles on State Highways) Bylaw 2004/3
Pursuant to section 61(3) of the Transit New Zealand Act 1989 and clause 2.6 of the Land Transport Rule: Setting of Speed Limits 2003 (Rule 54001), Transit New Zealand hereby makes the following Bylaw:
Title and commencement-This Bylaw may be cited as the Transit
New Zealand (Maximum Speeds of Vehicles on State Highways) Bylaw 2004/3 and shall come into force 28 days after its publication in the
New Zealand Gazette.
Interpretation-In this bylaw:
"School days" means the days on which the schools adjacent to the sections of State highway described in Part B of Schedule 1 are open for instruction.
"State highway" means any road that is a State highway as defined in section 2 of the Transit New Zealand Act 1989, and includes a motorway as defined in section 2 of that Act.
"Variable speed limit" means the speed indicated on the last activated variable speed limit sign passed by a vehicle in the direction of travel of that vehicle on the section of State highway for which the maximum speed is set, and in the case of the variable speed limit on the sections of State highway described in Part B of Schedule 1, is a speed limit of 40 kilometres per hour on school days between the hours of 8.25 a.m. and 9.00 a.m., and 2.50 p.m. and 3.15 p.m., or any other time if, in the each case, the appropriate variable speed limit sign is activated.
"Variable speed limit sign" means a sign indicating a variable speed and which meets the criteria set out in or under the Traffic Regulations 1976 and the Land Transport Rule: Setting of Speed Limits 2003.
"Vehicle" has the same meaning as it has in section 2(1) of the Land Transport Act 1998.
Validation-All speed limits saved under section 4 of the Transport Amendment Act 1997 are hereby validated, other than those set under the Land Transport Rule: Setting of Speed Limits 2003.
Variable speeds of vehicles on specified sections of State highways-
(a) No person shall drive, ride or operate any vehicle at a speed exceeding the maximum variable speed limit shown on the relevant activated variable speed limit sign on the sections of State highway described in Schedule 1.
(b) A variable speed limit may apply to vehicles traveling in one or both directions and different variable speed limits may apply in respect of different directions.
Speeds of vehicles on specified sections of State highways during holidays-No person shall drive, ride or operate any vehicle on the sections of State highway described in Schedule 2 at a speed exceeding the maximum speed limit of 50 kilometres an hour for the time period(s) specified in Schedule 2 which relates to each section of State highway described, or at a speed exceeding the maximum speed of 70 kilometres an hour for the remainder of the year.
Maximum speeds of vehicles on specified sections of State highways-No person shall drive, ride or operate any vehicle at a speed exceeding the maximum speed fixed in Schedule 3 to this bylaw on the section of State highway for which the maximum speed is fixed.
Revocation of bylaws-All prior Transit New Zealand bylaws setting speed limits of vehicles on State highways, including the Bylaws specified in Schedule 4 to this bylaw, are hereby revoked.
Schedule 1
Part A
The section of State Highway No. 1 that is the Ngauranga Gorge at Wellington commencing at Helston Road Bridge (Route Position 979/4.58) extending in a generally southerly direction to a point (Route Position 979/7.55) 270 metres south of the northern abutment of the Ngauranga Southbound Overbridge structure including the ramps and connections to and from the State highway; a distance of 3.6 kilometres.
The section of State Highway No. 1 that is the Ngauranga Gorge at Wellington commencing at the North Island Main Trunk Railway Bridge (Route Position 979/7.33) extending in a generally northerly direction to a point (Route Position 979/4.42) 70 metres north of Helston Road Bridge, including the ramps and connections to and from the State highway; a distance of 2.8 kilometres.

Part B
(a) The section of State Highway No. 74 that is on Main North Road in Christchurch City, from a point (Route Position 0/0.07) 100 metres generally in a north-easterly direction from the intersection with Swift Street extending to a point (Route Position 0/0.49) located 170 metres generally in a south-westerly direction from the intersection with Lagan Street; a distance of approximately 420 metres.
(b) The section of State Highway No. 75 that is on Halswell Road in Christchurch City, from a point (Route Position 0/6.04) 240 metres generally north-east of Larsens Road to a point (Route Position 0/6.44) 90 metres generally in a south-westerly direction from the intersection with O'Halloran Drive; a distance of approximately 400 metres.
That section of State Highway No. 6 commencing on Main South Road in Karoro at Greymouth, from a point 20 metres generally north of Rata Street and proceeding in a generally southerly direction to a point 30 metres generally north of Stanton Crescent (Route Position 430/4.02 to Route Position 430/4.33); a distance of 310 metres.
That section of State Highway No. 1 commencing on Craigie Avenue in south Timaru, from a point 140 metres generally north of Queen Street then proceeding to a point 160 metres generally south of Queen Street (Route Position 506/1.54 to Route Position 506/1.84); a distance of 300 metres.
Schedule 2
(a) On State Highway No. 12 (Ohaeawai to Maungaturoto via Dargaville) from Kokohuia Road to a point 1970 metres measured northerly, generally, along the State highway from Kokohuia Road; commencing 1 December each year and ending 30 April in the next ensuing year.
(b) On State Highway No. 6 (Blenheim-Invercargill via Nelson and Greymouth) from a point 320 metres measured southerly, generally, along the State highway from Pelorus Bridge to a point 320 metres measured north-easterly, generally, along the said State highway from Pelorus Bridge; commencing
20 December each year and ending 31 January in the next ensuing year.
(c) On State Highway No. 1 (Taupo) from Hawai Street to the Rainbow Drive northern intersection; commencing 20 December each year and ending 10 February in the next ensuing year, and from the Thursday preceding Easter to the Tuesday following Easter in each year.

This bylaw was made by resolution passed at a meeting of the Board of Transit New Zealand held in Wellington on the 1st day of September 2004.

Explanatory Note
This Note is not part of the bylaw, but is intended to indicate its general effect.
This bylaw is the validation required by section 10 of the Land Transport Rule: Setting of Speed Limits 2003. It validates the speed limits for vehicles on State highways saved under section 4 of the Transport Amendment Act 1997, except the 100km/h speed limit which generally applies on all roads within a rural area, and the 50km/h speed limit which generally applies on all roads within a designated urban traffic area (local authorities have generally excluded State highways from designated urban traffic areas so the speed limit for them is 100km/h unless otherwise specified in this bylaw.)
This bylaw also sets some new speed limits. The speed limits include some holiday speed limits, and some variable speed limits.
From time to time, Transit New Zealand will review the speed limits set in this bylaw in accordance with the Land Transport Rule: Setting of Speed Limits 2003 and make new or amending bylaws as appropriate.
