Public Notice The Treaty of Waitangi Act 1975 The State-Owned Enterprises Act 1986 This notice concerns land at 1, 2, 3, 4, 5 and 6 Westvale Avenue, Coroglen Gardens, Ranui, Auckland and Maori claims under the Treaty of Waitangi Act 1975. The land at Nos. 1, 2, 3, 4, 5 and 6 Westvale Avenue, Coroglen Gardens, Ranui, Auckland, is described in legal terms as: 1 Westvale Avenue: All that parcel of land containing 264 square metres, more or less, being Lot 85, Deposited Plan 181994 and being all the land comprised and described in certificate of title 113B/45 (North Auckland Registry). 2 Westvale Avenue: All that parcel of land containing 399 square metres, more or less, being Lot 77, Deposited Plan 181994 and being all the land comprised and described in certificate of title 113B/37 (North Auckland Registry). 3 Westvale Avenue: All that parcel of land containing 276 square metres, more or less, being Lot 86, Deposited Plan 181994 and being all the land comprised and described in certificate of title 113B/46 (North Auckland Registry). 4 Westvale Avenue: All that parcel of land containing 329 square metres, more or less, being Lot 76, Deposited Plan 181994 and being all the land comprised and described in certificate of title 113B/36 (North Auckland Registry). 5 Westvale Avenue: All that parcel of land containing 280 square metres, more or less, being Lot 87, Deposited Plan 181994 and being all the land comprised and described in certificate of title 113B/47 (North Auckland Registry). 6 Westvale Avenue: All that parcel of land containing 249 square metres, more or less, being Lot 75, Deposited Plan 181994 and being all the land comprised and described in certificate of title 113B/35 (North Auckland Registry). The land was once owned by the Crown. It was transferred to a State Owned Enterprise under the State-Owned Enterprises Act 1986. There is a special notice or ``memorial'' on the certificates of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27a and 27b of the State-Owned Enterprises Act 1986). The current owner of the land, UNIVERSAL HOMES LIMITED, has applied to the Waitangi Tribunal to have the notices removed. The application has been made under section 8d of the Treaty of Waitangi Act 1975. ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 24TH DAY OF JULY 1998. Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, 110 Featherston Street (P.O. Box 5022), Wellington. If no claim about this land is made to the Waitangi Tribunal before the 24th day of July 1998, then the Tribunal may recommend that the land no longer be liable to be resumed by the Crown and returned to Maori ownership under section 27b of the State-Owned Enterprises Act 1986.
