Notice of Decision of Committee of Appeal Notice is hereby given by the Committee of Appeal of the New Zealand Society of Accountants that at a conjoint hearing held on the 13th day of June 1994, the Committee heard submissions made on behalf of Peter Lewis Whittaker of Christchurch on his appeal against the orders of the Disciplinary Committee made on the 28th day of February 1994. The Disciplinary Committee heard charges against Peter Lewis Whittaker at a conjoint hearing held on the 28th day of February 1994 in that he was a bankrupt. Peter Lewis Whittaker appeared before the Disciplinary Committee and pleaded guilty to the charge as laid. The Disciplinary Committee found the charge proved, based on evidence that was heard and received at that hearing. Pursuant to section 23 (3) (b) of the New Zealand Society of Accountants Act 1958, the Disciplinary Committee ordered that Peter Lewis Whittaker be suspended from membership of the society until he obtained an annulment of/or discharge from bankruptcy, subject to that period not exceeding 5 years. Peter Lewis Whittaker was ordered to pay to the society the sum of $1,718.03 (incl. G.S.T.) in respect of costs and expenses of and incidental to the inquiry by the Disciplinary Committee and the investigation by the Investigation Committee. The Disciplinary Committee ordered that its decision be published in the Accountant's Journal, the New Zealand Gazette and Christchurch Press newspaper with mention of the member's name and locality. Pursuant to section 25 of the New Zealand Society of Accountants Act 1958, the member appealed against the decision of suspension from membership of the society. The Committee of Appeal dismissed the appeal and confirmed all the Disciplinary Committee's orders. Dated this 1st day of July 1994.
