The Treaty of Waitangi Act 1975 State-Owned Enterprises Act 1986 This notice concerns the land at 20 Clifton Road, Herne Bay, a former Herne Bay Postmaster's residence and Maori claims under the Treaty of Waitangi Act 1975. The land at 20 Clifton Road is described in legal terms as: First An estate in fee simple being an undivided one half share in 689 square metres, more or less, being Section 4, S.O. Plan 63118, Suburbs of Auckland. Subject to: (i) 27B of the State-Owned Enterprises Act 1986. (ii) Land covenant in lease C. 203512.2. (iii) Land covenant in lease C. 478567.3. (iv) Lease C. 203512.1. (v) Lease C. 478567.3. Second An estate in leasehold created by lease C. 203512.2 for the term of 999 years commencing on the 22nd day of September 1990 in Flat 1, Deposited Plan 141519, situated on the above described land. With the First and Second estates both being SUBJECT TO mortgage C. 448910.4 and both being comprised in certificate of title 83D/890 (North Auckland Registry). Third An estate in fee simple being an undivided one half share in 689 square metres, more or less, being Section 4, S.O. Plan 63118, Suburbs of Auckland. Subject to: (i) 27B of the State-Owned Enterprises Act 1986. (ii) Land covenant in lease C. 207512.2. (iii) Land covenant in lease C. 478567.3. (iv) Lease C. 203512.2. (v) Lease C. 478567.3. Fourth An estate in leasehold created by lease C. 478567.3 for the term of 999 years commencing on the 22nd day of September 1990 in Flat 2, Deposited Plan 147238, situated on the above described land. With the Third and Fourth estates both being SUBJECT TO mortgage C. 478567.4 and both being comprised in certificate of title 87D/94 (North Auckland Registry). The land was once owned by the Crown. It was transferred to a State Owned Enterprise under the State-Owned Enterprises Act 1986. There is a special notice or ``memorial'' on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27a and 27b of the State-Owned Enterprises Act 1986. The current owners of the land, STUART DAWSON CHRISP, KARL GEORGE GEISELER and KAYE LOUISE GEISELER have applied to the Waitangi Tribunal to have this notice removed. This has been done under section 8d of the Treaty of Waitangi Act 1975. ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 17TH DAY OF JUNE 1994. Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington. The following claims already submitted to the tribunal may relate to this land: WAI 72 Ngati Paoa Lands and Fisheries claim by H. Gordon. WAI 121 Ngati Whatua Lands and Fisheries claim by E. Manukau and T. Paki. WAI 276 and 388 Sylvia Park and other Ngati Whatua Lands claim and Ngati Whatua O Orakei Trust Board Claim by R. H. Grey and others. WAI 393 Te Uri O Hau claim by Mrs M. Hakopa. If no claim in respect of this land is submitted under section 6 of the Treaty of Waitangi Act 1975, before the date specified in this notice, the tribunal may recommend that the land or interest in the land be no longer liable to resumption under section 27b of the State-Owned Enterprise Act 1986.
