District Anglers (Nelson/Marlborough Fish and Game Region) Notice 1994 Pursuant to section 26r (3) of the Conservation Act 1987 the Nelson/Marlborough Fish and Game Council hereby gives the following District Anglers Notice. N o t i c e 1. Title and commencement This notice may be cited as the District Anglers (Nelson/Marlborough Fish and Game Region) Notice 1994 and shall come into force on the 1st day of October 1994. 2. Interpretation Words and expressions in this notice which are defined in the Conservation Act 1987, or the Freshwater Fisheries Regulations 1983, shall have the meaning so defined. 3. Open season (1) Subject to subclause (2) of this clause and to clause 4 of this notice, there shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive). (2) There shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in the following waters (not including tributaries); (a) Aorere River downstream from the road bridge at Rockville; (b) Awatere River; (c) Buller River downstream from the confluence with the Mangles River; (d) Clarence River downstream from Glen Alton bridge; (e) Cobb Reservoir; (f) Conway River; (g) Lake Argyle and the Branch Power canal below the lake downstream to its confluence with the Wairau River; (h) Lyell Creek (Kaikoura) downstream from State Highway No. 1; (i) Maitai River below the Nile Street bridge; (j) Matakitaki River downstream from the State Highway No. 6 bridge; (k) Middle Creek downstream from State Highway No. 1; (l) Motueka River downstream from the road bridge at Ngatimoti; (m) Oaro River; (n) Opawa River downstream from State Highway No. 1 bridge; (o) Pelorus River downstream from its confluence with the Rai River; (p) Queen Charlotte Sound in an area of 500 metres radius from the mouth of all inflowing streams; (q) Takaka River downstream from its confluence with the Waingaro River; (r) Taylor River downstream from the New Renwick Road bridge; (s) Waimea or Wairoa Rivers downstream from the confluence with the Lee River; (t) Wairau River (including the Diversion) downstream from the Wash Bridge. (3) A licence holder shall not fish for, or take or attempt to take, any sports fish except during an open season. 4. Closed Season (1) There shall be a closed season for fishing for sports fish (i) In the Brook Stream located in Nelson City from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive). (ii) In respect of the taking of quinnat salmon (Oncorhynchus tshawytscha) in those waters of the Wairau River lying upstream of the Wash Bridge from the 1st day of October in any year until the 30th day of September in the following year (both days inclusive). 5. Authorised Tackle (1) A licence holder shall not fish for or take any sports fish except by using a rod and running line, except that when playing a sports fish, a landing net may be used to secure or land any such fish. (2) A licence holder shall not use in fishing for, taking or attempting to take sports fish, or have under their control, more than one assembled rod and running line at any one time. (3) A licence holder shall not fish for sports fish unless they are within 15 metres of the rod being used and have the rod under their own visual observation. (4) A licence holder in fishing for sports fish shall not fish from any boat or any floating device, in those parts of Lake Rotoiti and Lake Rotoroa within a radius of 100 m from the centre of the meeting lines of those rivers and streams listed: Lake Rotoiti (a) Travers River; (b) Coldwater Stream; (c) Black Valley Stream; (d) Buller River; Lake Rotoroa (a) Sabine River; (b) D'Urville River; (c) Gowan River. 6. Authorised lures and baits (1) A licence holder shall not fish for sports fish with any artificial or natural bait or lure other than fly, insect, worm, crustacea, minnow or fish (excluding fish ova, any portion of a fish or any shellfish (Mollusca)) or coloured bread dough.. (2) A licence holder in fishing for sports fish shall not use any lure or bait other than artificial minnow or artificial fly in the following waters and all their tributaries; (a) Acheron River; (b) Clarence River above Glen Alton bridge but excluding Lake Tennyson; (c) Cobb River upstream of its confluence with the Cobb Reservoir; (d) D'Urville River; (e) Goulter River; (f) Maitai River (except the holders of junior licence); (g) Mangles River; (h) Motupiko River; (i) Opouri River upstream from and including the Ronga River; (j) Owen River; (k) Pearse River; (l) Riwaka River; (m) Sabine River; (n) Spring Creek; (o) Travers River; (p) Wairau River above the Wash Bridge; (q) Whakapuaka River. 7. Prohibition on unauthorised fishing equipment, etc. (1) A licence holder shall not, when fishing for sports fish, use or be in the possession of, or be in control of, or convey or cause to be conveyed to the vicinity of any place where the licence holder is fishing or proposes to fish, any paravane, any stoke hauling or foul hooking gear, or any spear or gaff, any narcotic or poisonous substances or liquid injurious to fish. (2) A licence holder shall not, when taking or attempting to take or when in possession of, any sports fish, be in possession of or be in control of, any spear gun or pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device. (3) In this clause the term ``explosive'' has the same meaning as in the Explosives Act 1957. 8. Use of nets Subject to clause 5 (1) of this Notice, a licence holder shall not use or cause to be used for taking sports fish a net of any description. 9. Daily limit bag (1) A licence holder shall not on any day kill or be in possession of more than one (1) sports fish from the following waters (including tributaries); (a) Riwaka River. (2) A licence holder shall not on any day kill or be in possession of more than two (2) sports fish from the following waters (including tributaries); (a) Coastal rivers and their tributaries meeting the sea between and including the Awatere and Conway Rivers, but excluding Lake Tennyson; (b) Cobb River above the Cobb Reservoir; (c) D'Urville River; (d) Kaituna River (Havelock); (e) Motupiko River; (f) Opouri River; (g) Owen River; (h) Pearse River; (i) Pelorus River tributaries and the mainstream above State Highway No. 6; (j) Rahu River; (k) Sabine River; (l) Travers River; (m) Wairau River upstream of the Wash Bridge; (n)Wairau River tributaries; (o) Warwick River; (p) Woolley River. (3) With respect to all other waters a licence holder shall not on any day kill or be in possession of more than four (4) sports fish of which not more than two (2) may be salmon. (4) A licence holder who on any day, has already taken a limit bag from those waters specified in subclauses (1) and (2) of this clause, shall not, continue to fish in any of those waters, on that day. (5) A licence holder who on any one day, has taken four (4) sports fish from the waters referred to in subclause (3) of this clause, shall not continue to fish on that day. 10. Minimum size to be taken (1) There shall be no minimum size for sports fish, except as provided for in subclause (2) of this clause. (2) A licence holder shall not have in their possession any sports fish which does not exceed 25 cm in length from the following waters (i) Buller River, in the area from and including the outlet of Lake Rotoiti, which comprises of a radius of 100 m from the centre of the meeting lines with the Buller River, to the first bridge across the Buller River on State Highway No. 63. 11. This Notice shall apply to all fresh water watercourses, ponds, lakes and rivers of all sizes and descriptions within the Nelson/Marlborough Fish and Game Region and the words ``water'' and ``waters'' shall have a corresponding meaning. 12. Revocation The notice published in the supplement to the Gazette, 151 on Friday, 31 August 1990, on pages 32113213, titled District Anglers (Nelson-Marlborough Fish & Game Region) Notice 1990 and amendments 1, 2, and 3 are hereby revoked.
