Notice of Direction to Safeguard Security Enhanced Areas

Pursuant to section 77B(1) of the Civil Aviation Act 1990, I, Keith Manch, Director of Civil Aviation, considering sections 5, 5A, 11 and 12 of the Aviation Crimes Act 1972 and based on a reasonable belief that a security risk exists, hereby direct the Aviation Security Service as follows:

Part I – Screening and Reasonable Searches

In a random and unpredictable manner and in accordance with the powers and duties of aviation security officers as described in section 80C of the Civil Aviation Act 1990 and the requirements of Civil Aviation Rule Part 140 A.25, screen and, if necessary, undertake reasonable searches of any:

  1. Person, item, substance or vehicle
    1. Before entering a security enhanced area, or
    2. Present in a security enhanced area
  2. Any unattended item, substance, or vehicle in a security enhanced area.

Security enhanced area means an area that the Director has declared to be a security enhanced area under section 84(1A) of the Civil Aviation Act 1990.

Screening and reasonable searches are to be undertaken in respect of the items listed in Schedule A of this notice for the purposes of safeguarding civil aviation against acts of unlawful interference as defined in Civil Aviation Rule Part 1.

Part II – Seizing

In accordance with section 77B(1)(c) and 80C(3) of the Civil Aviation Act 1990, seize and detain any item or substance specified in Schedule A of this notice, unless:

  1. There are reasonable grounds to believe that there is lawful authority or reasonable excuse for the item to enter and remain within the security enhanced area.

Schedule A – Items Prohibited from Entering or Remaining in the Security Enhanced Area

Subject to Part II (a) of this Notice, the screening, reasonable searching and seizing referred to in Parts I and II should ensure that the following items are prohibited from entering or remaining in the security enhanced area:

  1. Explosives and incendiary substances and devices capable of being used to commit an act of unlawful interference, including:
    1. dynamite, gunpowder and plastic explosives
    2. mines, grenades and other explosive military stores
    3. detonators and fuses
    4. blasting caps
    5. pyrotechnics, including fireworks
    6. smoke-generating canisters or cartridges
    7. ammunition
    8. replica or imitation explosive devices
  2. guns, firearms and other devices that discharge projectiles designed to cause serious injury by discharging a projectile, or capable of being mistaken for such devices, including:
    1. firearms of all types including pistols, revolvers, rifles and shotguns
    2. component parts of firearms, excluding telescopic sights
    3. compressed air and carbon dioxide guns, including pistols, pellet guns, rifles and ball bearing guns
    4. signal flare pistols and starter pistols
    5. bows, crossbows and arrows
    6. harpoon guns and spear guns
    7. slingshots and catapults
    8. toy guns, replicas and imitation firearms capable of being mistaken for real weapons
  3. stunning devices designed specifically to stun or immobilise, including:
    1. devices for shocking such as stun guns and stun batons
    2. animal stunners and animal killers
    3. disabling and incapacitating chemicals, gases and sprays such as mace, pepper or capsicum sprays, acid sprays, animal repellent sprays and tear gas
  4. any dangerous or offensive weapon, item or substance capable of being used to endanger the safety of an aircraft or cause bodily injury

Subject to section 77B(6) of the Civil Aviation Act 1990, this Notice of Direction replaces and rescinds the previous notice dated 12 July 2012 and published in the New Zealand Gazette, 19 July 2012, Issue No. 86, page 2378.

This Notice of Direction shall take effect on 11 September 2023. A copy of this notice will be publicly available on the Civil Aviation Authority of New Zealand website www.aviation.govt.nz.
